Below are our terms and conditions, and the default policies that apply to all of our productions. If any of this does not meet your expectations, please contact us — we’re happy to discuss amendments.
These terms and conditions are for your protection as well as ours. Please read them carefully.
Fees
1.1 Fee Estimate
Our fee quotes are based on an estimate of the time and work required to complete each project. We will always endeavour to complete the work within the estimated fee. If the project scope changes or is likely to involve additional time or cost, we will agree any revised fee with you before proceeding.
Each estimate includes pre-production services, which are often carried out before a final quote is issued. Should the client decide not to proceed with the project after this stage, they agree to compensate OH! Films for all work completed and any expenses incurred to date.
1.2 VAT
All figures exclude VAT unless stated otherwise.
1.3 External Costs
External costs (including couriers, taxis, travel, subsistence, accommodation, and image/footage/music licensing fees) are charged to the client unless itemised in the estimate. Any major costs exceeding £100 not included in the quote will be agreed with the client in advance.
1.4 Payment Terms
Fees will be invoiced as follows:
- 50% upon sign-off of the budget (payable before project commencement)
- 50% upon completion of the first draft of deliverables
Our payment terms are strictly 28 calendar days from the date of invoice.
After this period, OH! Films reserves the right to apply an accumulative weekly penalty fee of 1.5%.
The client shall be responsible for any collection or legal fees necessitated by late or defaulted payment. OH! Films reserves the right to withhold delivery of materials and transfer of intellectual property rights until full payment has been received.
Content & Intellectual Property Rights
2.1 File Storage
Unless otherwise stated, OH! Films will store all project files for one year following project sign-off. We accept no responsibility for any issues arising from file deletion after this period.
Copyright (Material Created by OH! Films)
All material captured or created by OH! Films is solely owned by OH! Films and protected under UK copyright law.
Upon project completion and full payment of all fees, OH! Films will transfer partial copyright ownership of the final deliverables to the client.
All original media files (raw footage, project files, etc.) remain the intellectual property of OH! Films.
OH! Films reserves the right to use any content, in part or in full, for promotional purposes.
2.3 Copyright (Material Provided by the Client)
If the client provides any material for inclusion in an OH! Films production, they must first obtain copyright clearance from the original rights holder.
The client agrees to indemnify OH! Films against any future claims, disputes, expenses, or other liabilities arising from the use of such material.
OH! Films reserves the right to use content, in part or in full, for promotional purposes.
2.4 Intellectual Property
Upon project completion and full payment of all fees and expenses, OH! Films will transfer partial copyright ownership of the final product to the client. Thereafter, OH! Films and the client will share ownership of the final product.
The client may not modify, re-edit, or display the final product in any form other than as agreed at project commencement.
Conclusion
All terms and conditions stated above are deemed accepted by the client upon project commencement.
Privacy Policy
Information Security and Privacy Policy
You may browse our website without providing personal information. Where you voluntarily provide personal data (e.g., name, email address, phone number), it will be used solely to communicate with you regarding our services.
Subject to applicable laws, we may monitor and record communications (emails, text messages, social media messages, etc.) relating to our dealings with you.
OH! Films complies with the UK GDPR and respects your rights to access, correct, or erase your personal data.
How We Use Collected Information
OH! Films will only use your personal data as necessary to perform our contract with you, and as required for accounting, management, and auditing of our business operations.
How We Protect Your Information
All photos, recordings, and personal data are securely stored to prevent unauthorised access, alteration, or disclosure.
We archive media recordings (photos and video) so that future projects can reuse existing relevant assets, reducing unnecessary reshoots. If you do not wish for your materials to be archived, please notify us in writing, and they will be securely deleted upon project completion.
Sharing Your Personal Information
We do not sell or allow third-party access to your personal information.
We may disclose your personal data only if required by law or if you violate these Terms and Conditions. Subject to data protection law, OH! Films may share data with trusted subcontractors, professional advisors, or relevant government bodies as necessary to provide our services or comply with legal obligations.
Photography and Filming
Images or footage of individuals may constitute personal data under the Data Protection Act 2018 and UK GDPR.
Consent will be obtained from anyone whose image is the primary focus of a photograph or film.
Filming in Public or at Events
When filming in public spaces or large groups, it is not necessary to obtain consent from individuals incidentally captured in the background.
OH! Films will display a visible notice where filming is taking place, allowing individuals to opt out by moving out of view.
Withdrawing Consent
Individuals may withdraw consent at any time in writing. Once withdrawn, OH! Films will cease using the relevant images, though it may not be possible to remove them from previously released materials.
Copyrighted Assets
Photographs, film, sound recordings, and still images are protected by copyright. OH! Films retains ownership of recordings it produces, while clients retain copyright in their original materials (e.g., presentation slides, scripts, or dialogue).
The client must ensure that any third-party materials captured during filming do not infringe existing copyrights and that OH! Films is permitted to use them for the agreed purpose.
Changes to This Policy
OH! Films may update this policy from time to time. Clients are encouraged to review it periodically to stay informed about how we protect and manage personal information.
